1. This Skeleton Argument is intended primarily to introduce the factual background and legal

issues applicable to the question for determination at this Preliminary Hearing, namely:

“was the unfair dismissal complaint presented outside the time limits in sections 111(2)(a)

& (b) of the Employment Rights Act 1996 and if so should it be dismissed on the basis that

the Tribunal has no jurisdiction to hear it?” (see Notice of Hearing, 24 July 2023 at [44]).

2. R has also made an application for strike out or deposit orders on the basis that the claim is

out of time, but R does not pursue this. Instead, R simply invites the Tribunal to dismiss the

claim on the basis that it was presented out of time.

Tax back this month. (companies know about this) It was on purpose, I was one of the top performers and constant positive feedback by guests to validate this. Racxxx signed off the shifts. Crying out for staff October half term week.

 

Prior to this approximately 4 shifts per week. Weekend shifts.

 

Felt like torture in the Games section, noise level - came out of work - Penetrating headaches, very sick for approximately 6 weeks, bought on panic attacks.

Perhaps a  coincidence that the dyslexic, labourer man subletting the house in Brookland's had verbally assaulted me in September, distressed, reached out to Gxxxxx at Mercedes- Benz world as a witness - maybe the brand no longer wanted me? Made me sick

​

Disruption on trains (government) and car failed mot.

3 weeks notice as friends were coming to stay to sit exams - started off by making friends, get into my business then Greg became unkind - crossed boundaries.

 

Walton - Lovely victorian house - friendly girls - care workers from Kenya - not actually care workers but trained in England, better life government scheme - private house, car etc - landlord lived round the corner...not aloud a cat and one of the care worker friends moved in to my room

Behind the scenes - assaulted by a dyslexic man who was also unbeknown to me an alcoholic drinking bottles of Kylie Mxxxxxx wine and collecting the bottles on the sideboard next to the fridge. and clearly dysfunctional. (irrelevant that he was dyslexic and I never judged, he told me.) BUT the interview for the room involved me answering questions by his mother, well that is what I was told. A copy of my passport and latest cv so they had already gathered so much information on me - what did I get from them? Nothing. They wanted a months rent in advance followed by £225.00 per week. No lock on the bedroom door and when I asked for one he said NO. . How nice to offer to pick up my new double bed from storage - looking back feels like entrapment, wreckless driving in a hire van on the way back to the house and already told me some of his family worries, and he had split from his wife, had children and his father had cut him off. The day I moved in - thanks. Gut instinct told me to be careful.

It then transpires that he was the carer for the mother, so it was just me him and the mum in 3 bedrooms in a 5 bed house! Then a Romanian chef moved in to the 4th bedroom followed by 2 Romanians in the front room/snug downstairs and another man upstairs when the mum moved out! What made me very scared was when he said "I've heard about you" I did not respond but I had never heard about this person before and I did not and do not know him. I rented a room for work and was very rarely there. SO what have you heard exactly in the rumour mill or hate crime which is social media? He bought him and his ex a new years eve ticket, 2022 to a masquerade party in an exclusive hotel in London and sat on a table with a supermodel and clearly likes to cling to famous people, he showed me his mask. Even more scary was the stabbing of the microwave meal with a knife over and over at approximately 10:30 pm - my bedroom which was above the kitchen, nearly every night. 

When he went for me he said he was "A disruptor" reminded me of an Andrew Mxxxxxx type character when I look back.

In a previous conversation he had told me he used to go into schools to motivate students - this is a man who told me he was expelled?

He woke me up one night approx 1:30am him and his mother screaming at each other in the garden, I had work the next day. They used to have a doughnut cushion which seemed to be moved about and the day of an f1 race the cushion would be placed on the chair at the bottom of the stairs, odd. 

​

Feels like a stitch up - My work colleague, friend used to buy a doughnut cake on a Saturday and the f1 drivers were doing doughnuts and mucking about. Do they all know each other or something?

​

 

I moved to a crappy house in Walton to remain close to work (Brooklands) - failed to tell me the daughter was special needs - thought it was fun to keep me awake by flashing Christmas lights outside the front room window to keep me awake. Playing loud computer games and other things above my head. I was the only one going out to work... pushed me out so they could have there Christmas dinner in my bedroom - they did give me notice and paid me the additional rent days back - paid for a hotel over Christmas.

December 2023 as close to death as I have ever felt, body fighting, bed ridden with what I believe to be Norovirus - ibuprofen and somehow fought it off, one day sick from M&S and scheduled days off - somehow found the strength to carry on "It was a case of having to"

No sick pay and  not granted statutory sick pay.

Assaulted / BULLIED by incompetent Operations Manager (not really an ops manager just given the title - not what you know but who you know) Terrorist. Not once but twice, once in front of 2 witnesses, they just sat there, this will come back to haunt you!

A lovely evening meal to thank a few of us for our hard work in the restaurant, the fitness manager got her photo of me. Thank you card handed out. Following shift Operations manager (nothing to do with me) called me to the office and intimidated me and verbally assaulted me.

​

Panic attack, I asked to leave the meeting and he refused to let me leave. I went anyway and had to take the rest of the shift of and 1 sick day the following shift.

​

Pushed out at the end of 6 month probation, whilst GM and Fitness manager both off on a weeks holiday during the busiest month of the year, January.

​

​Eastern European - Paulius

Toxic culture - headless chickens, behaviour by some of the staff disgraceful, disrespectful and spiteful - Elxxx (TK MAXX ) and Stuxxx came to the accommodation and demanded the key.​

They were assistant managers under the fitness manager on holiday. I was recruited bu the GM. None of them had the right to do what they did.

​

And why did Rxxxx bend over and show her ass to me on the day I was pushed out - very rude and disrespectful. Disgusting behaviour from the 18 - 25 years olds. Cloud 9 young girl rude and bullying - I would never pay money to be looked after by you.

Members - the rudest woman looking after members - surprised if you have any members left, sales person really.

Pushed me out of staff accommodation and made homeless - which by the way had a dodgy gas boiler, naked flame, no hot water for weeks, filthy. They still took a deposit which is yet to be refunded for the pleasure. 

No monthly pay for the month of November as they took all rent monies from the day I moved into the filth pit.

2024 which left no money until January 2025. When I took the roie it did not come with accommodation, I did not even ask for this caravan. May 2026, HMRC now asking for outstanding debt on a benefit that I never even asked for, HR did not complete the form and tax code correctly.

Bullied by the staff for not having a digital phone i phone or similar and for using my Nokia, trying to switch off from the digital frenzy for a start. Young staff always on digital phones - bringing social media into the work place - distraction and disruption. (Lord of the flies)

So many customer/client complaints during my time here. Lots of accidents. Already a cover up and lots of staff fired before I started.

Management style, micro management (hospitality qualification from Spain) and a dictatorship style culture in Fitness.

Staff food inedible, staff conditions a disgrace.

Walked into a dump. had to clean up after the last supposed wedding coordinator , the daughter of the pub manager next door. 

Previous wedding coordinator before this one, very sick.

I was not recruited to sort out other peoples mess. 

 

(A wedding coordinator is a professional who focuses on executing the logistical details of a wedding on the day of the event, ensuring everything runs smoothly and according to plan).

H = thought her job was to order me around and make me move chairs - nasty / bully - lived in the Hotel. Could you not be part of the team and help to move chairs instead of bark orders?

P on reception thought she was running the hotel, due to her seeing and receiving my CV thought she was above me a bit like Gill/Jill Toms - this type of person is everywhere they damage companies. What does your CV look like?

H the magistrate "I'm so important" Threatening behaviour and disruption and bully.

Between her and the pub manager stirring it all up and also thought she was running the show. Going on and on and on and round and round and round. An example would  be the pizza oven and umbrellas in the secret garden when we had so many weddings and events to deliver. Suppose to be the trustworthy and stable one! Why didn't you have the meeting elsewhere instead of in my ear.  Dissect.

Her job as far as I was aware was to pay the wages and collect the post.

​She was gossiping and going round upsetting the staff.

 

They had a favourite swear word they all uses to use = it's so bad I cannot repeat it.

I had a few days off and when I returned the new owners had removed the fish and planned to remove the pond and were focusing on ripping out the dolphin fountain in the secret garden - more complaints from the bride to sort out.

This is what I really think was going on,on the back of conversations and what I saw and read.

​

A very important family had a dream wedding booked - it had kicked off Christmas / New Year 2024 in the pub next door and the wedding coordinator before me could not "or they did not want her to" deliver the wedding.

They thought they could bring me in to sort out the mess and pull off this important wedding then push me out? However, I had met with many of the brides, they had not planned for this?  L kept saying her name over and over,very rude, I had only just started.  Possibly the plan was to bring her straight back after this particular wedding?

Then it looks like a trick / Breach ​

• Policy or Union grievance.

If the grievance is ignored or only considered very superficially, this can give the employee the option to resign and claim constructive unfair dismissal. In most cases, the employee needs two years' service for this.​

CRUEL = willfully causing pain or suffering to others, or

feeling no concern about it. Spoil or ruin (an opportunity or a chance of success).​​

Forgot to share with you the one wedding where the lady had been chucked out and collapsed intoxicated on the cold concrete floor outside the hotel.

Some aggressive behaviour between bar member and customer. (he still has his job)However you can not leave a woman on the concrete floor and threaten to throw her into the river. Lucky I was there and with her friend able to get her into a wheelchair and wheel her to the premier Inn. This is not what I was paid to do! Found out along the way that she used to be recruitment at British Airways!

At times felt very unsafe with one man who looked like Bear Grylls able to come right up behind me in the kitchen and leaning over my shoulder placed a knife back in its place.

Suppose to be able to turn up, one evening turned up but gentleman on the phone would only accept bookings online and turned me away. It was not full with plenty of grass patches for tents.

Christmas role at John Lewis

​

The worst Christmas dinner in the staff room that I have ever had - that night I was not very well.

​

Looked like slop, would not feed to a pig.

​

The shelves were filthy - had time to chatter but not a few seconds to wipe down a shelf with thousands of pounds worth of stock.

​

Worked the Christmas temps until empty and exhausted. Some of the staff on the bedroom floor stand around and do nothing, gossip! Same as some of the trainers and same as some in the beauty department.

​

No Christmas bonus for the temps that supported the team and did the work!

​

Trainers thought it was there job to stand behind us and monitor us and go after us if we did not have the headset on

Dad very unwell but still better at home than in a care home as he has everything he needs.

​

Now he seems to have an addictive personality mainly infront of the TV, music loud in the morning and evening and does this funny breathing to bring him back to the moment I think.

 

We have had a particularly bad winter and he likes to spend his money on rubbish and he likes to cause arguments. He likes to fight (Thatcher). 

​

He likes to talk about money every day. Makes out he is poor then makes out he is rich and that we all want things.

​

Acts suspicious -jekyll and hyde character. Manipulative tactics. (he used to be in the army but years ago before I was born).

​

Makes out I am some rotten penny and then the next minute wants to take me to the pub for dinner.

​

Begrudges me staying on a camp bed and often talks about me rotting in the gutter.

​I think he gets me confused with somebody else.

​

I should be in my own home, possibly married with children  and popping in to check on my sick father and support my mother when required. It was always going to be unhealthy staying overnight with somebody really ill.

​

I don't think either of my parents wanted me to marry or have children to be honest. In fact the more I look at this the more it looks like I have been hurt on purpose.

​

Ohhhhh they like me enough to travel the world in upper class and fulfil some of their dreams like going to Florida or visiting the elephants in Kenya, they have forgotten all that!

​

Yeah liked me when I could bring back nice things. Loved me then!

​

He has created a dream world in which a house clearance man has turned up. (he sells things as well) 

Since covid - apparently recommended by the allotment society. I had never heard of him or met him, not that this matters, none of my business but, prior to covid we did actually communicate as a fairly standard normal family. Have meals together and fairly stable compared to others I have met along the way. I was happy with my lot, would not change my parents at all. BUT what has happened since covid is unforgivable.

 

The first time I met Terry was when he did a job for my dad dropping off my childhood things from the loft during lockdown in Huntingdon. I was able  to sort some pieces out that I had not seen for years, some was my sisters, just old school work and books mainly.

​

My old Virgin Atlantic suitcase was taken to the dump and other things given to charity - but he had seen my things - he had helped my dad and sorted out my things - BUT why could I not have done this when I moved in years before - I did not give permission for my things to be touched but agree I needed them moved. They just did it.

​

Apparently this man is now 75 - he just got back from three months in Thailand with his Thai girlfriend. I have only met him a handful of times. He has been previously married twice but again nothing to do with me - I do not know him.

​

But yet they rip into me, make out I'm rude yet the second time ever meeting him when I still had a bedroom to stay in he said through the other side of the window "what are you doing here" in a really horrible tone, I did not expect this at all. 

​

They have made out I pull up vegetables over the allotment and lie about me. Why would I do that? My sister and I used to play over there and on occasions help my dad - he had the allotment for 40 years, it was a huge part of our childhood this is where he spent most of his time but end of 2025 he gave it all up including the orchard too ill.

​​

Once when I was visiting and my dad was still driving I expected my mum to be in the passenger side of the car but it was him.

​

My Dad had said he was going to cut the grass but over the last few years has been at the house every week doing odd jobs, sometimes 3 days a week, looking round the home and always wants to know where I am living. He asks to many questions.

 

He brings his girlfriend round the house and even sit round the pond together eating steak from the local butchers which is nice that they have made friends and that he brings broken gifts for my mum but do not make up things about me and gossip.

 

His girlfriend called  "cherry" pulled up my mums plants and made my mum sick, still makes us sick. He still keeps going round, something else broken to fix but it wasn't broken a few weeks ago. Another job another job, cash in hand.

​

Various other things have happened and broken but my Dad allows it to go on and on and on and yet blames me . Its just the most bizarre behavior and horrible and untrue.

​

The pond is where they like to have meetings and discuss things. This is where I was verbally battered for not showing a 5% shares certificate in a2bairportparking ltd trading as a2btravelextras.com, made out I am some kind of liar and why was I pushed out etc etc (2015)  and on it goes getting into my private affairs. This was my childhood home and suppose to be a safe place to visit my family.  since covid it has been horrible, a work house not a home. 

​

One day when I still had use of my old bedroom with a double bed when I would stay over for usually 1 night, any more than 2 and my dad turns on me (before my dad really sick) I used to visit approximately once every month, if not on a Sunday every three weeks if I was living closer. I would also meet my Mum in town when possible to check in and support. 

​

Totally taken advantage of and hurt. No help from any charity or nurses or doctors. 

​

Dad on so many drugs.

​

Parents do not communicate with me at all.

​

Push me around and since all of the medication verbally bully me even more.

​

He turns in on himself and keeps going back to the 80's.

​​

My dad says the "gardeners name"  everyday like he has some hold over him.

​

​

My aunty knows him but my mum asked no questions. I do not get involved and therefore  have not asked but I get dragged into things.

​

Defamation of character.

They keep getting me confused with this girl called Kerry who lived up the road who had five brothers and a family. There were a few poorer families and struggling families that my dad would help but he did not want me or my sister to mix with them. 

We were too busy and too young to think about this but clearly I was in danger when I was younger but did not know it.​

​

When my dad had sepsis and was in the emergency unit his eyes were so cold, he looked so cruel and had a huge go at me in the hospital, verbally abusing me because I did not have a house anymore or a stable career at that time. This was not my fault but in his eyes I was this failure, I give this back to the bad companies, something so wrong.

​

Then he wants to call a meeting and say "right listen to me, me and your mum have decide to loan you some money, just listen.....and on it went"

​

He just like to lord it up over me and have power over me, yet here he was so sick with sepsis and using me as a punch bag. 

​

What did I do to deserve this?

​

The day I needed a bed, a seed had already been sewn in my mums head, by Terry to cut up a single bed and give it to the dog.

​

​

The dog was sleeping on a bed and I was sleeping on the floor like some rotten, bad person. It was on purpose.

​

BAD!

All because I was pushed out of a company in 2015 (well I was the signature brand and it had actually been given to me, I had actually built it, but then given some shares instead with monthly board meetings) Sold a car (my mum likes me with a car so she can have days out or take out the dog somewhere different) and sold my home and a few bits and pieces to survive. 

​

Not good enough if I do not own a house and have a car.

​

A few of them have enjoyed watching me suffer. 

​My Dad has always preferred other families, some people are just like that.  He has always been sick and taken advantage of, he has always been vulnerable. I was the one that held it all together.

​

But clean, tidy and always had enough money - my family has been targeted by council and jealous families, the Lxxns, who used to live up the road.
